General Terms and Conditions

These Terms and Conditions govern all services provided by Chacham SRL, Pietrari 3A, Fălticeni, Suceava, Romania, CUI 51411876, and Lovely Giants, #301-603, 350-23, Gwangju-si, Gyeonggi-do, South Korea, Registration Number 1011865257 (hereinafter referred to as "the Company").

1. Scope of Application
These Terms apply to all contracts, services, and agreements between the Company and its clients, unless otherwise expressly agreed in writing.

2. Services
The Company provides services in the field of media production, including but not limited to video production, photography, content creation, and consulting. The exact scope of services is determined by individual agreements with each client.

3. Offers and Contracts
All offers are non-binding until confirmed in writing. A contract is considered concluded once the Company issues written confirmation or commences service delivery.

4. Client Responsibilities
Clients must provide all necessary information, materials, and approvals required for the execution of services. Delays caused by the client may extend delivery timelines.

5. Liability
The Company is not liable for indirect, incidental, or consequential damages. Liability is limited to intent or gross negligence and capped at the value of the agreed service.

6. Intellectual Property
All rights to concepts, drafts, videos, photos, and other content remain with the Company until full payment is received. After payment, rights of use are transferred to the client as agreed.

7. Confidentiality
Both parties agree to treat confidential information obtained during cooperation as strictly confidential.

8. Jurisdiction
For Chacham SRL, Romanian law applies and the competent courts of Romania shall have jurisdiction. For Lovely Giants, Korean law applies and the competent courts of South Korea shall have jurisdiction.

General Terms and Conditions

Payment Terms
Payment is made in two installments of 50% each.
The first payment is due after filming, and the second payment is invoiced after all deliverables have been provided.

Editing and Revisions
Two rounds of revisions are included free of charge. Additional revisions will be charged separately.
If no feedback is provided within 30 days after the edited video has been delivered, the project will be considered completed.

Data Retention and Deletion
Client project files will be stored for three (3) months after completion. Unless otherwise agreed in writing, all data will be permanently deleted thereafter.

Copyright
Unless exclusive rights are purchased, the Company retains the right to use the project materials for its own portfolio and promotional purposes.

Contract Termination
In the event of client cancellation, the following fees will apply:
– 4 weeks before project start: 10% of the agreed amount
– 3 weeks before: 20%
– 2 weeks before: 30%
– Up to 24 hours before: 60%
– Within 24 hours: 100% of the agreed amount

Force Majeure
In the event of force majeure such as natural disasters, accidents, or illness, project details and schedules may be adjusted by mutual agreement.
The Company is not liable to provide compensation for delays, cancellations, or changes resulting from such circumstances.

Dispute Resolution
All disputes shall first be attempted to be resolved through informal negotiation between the parties.
If resolution is not possible, disputes may be handled through arbitration either in the jurisdiction where the filming takes place or in South Korea, depending on the circumstances.

The website located at www.lovelygiants.com is a copyrighted work belonging to Chacham SRL of Romania, with registered office at Pietrari 3A, Fălticeni, Suceava, CUI 51411876, and Lovely Giants of South Korea, with registered office at #301-603, 350-23, Gwangju-si, Gyeonggi-do, registration number 1011865257.

Certain features of the Site may be subject to additional guidelines, terms, or rules, which will be posted on the Site in connection with such features.

All such additional terms, guidelines, and rules are incorporated by reference into these Terms.

These Terms of Use describe the legally binding terms and conditions that oversee your use of the Site.
BY LOGGING INTO THE SITE, YOU AGREE TO BE COMPLIANT WITH THESE TERMS and you represent that you have the authority and capacity to enter into these Terms.
YOU SHOULD BE AT LEAST 18 YEARS OF AGE TO ACCESS THE SITE.

본 약관은 다음 회사가 제공하는 모든 서비스에 적용됩니다.

1. 적용 범위
본 약관은 회사와 고객 간의 모든 계약, 서비스 및 합의에 적용되며, 서면으로 달리 합의하지 않는 한 유효합니다.

2. 서비스
회사는 영상 제작, 사진 촬영, 콘텐츠 제작 및 관련 컨설팅 등 미디어 제작 서비스를 제공합니다. 구체적인 서비스 범위는 개별 계약에 따라 결정됩니다.

3. 계약 체결
회사의 모든 제안은 서면으로 확인될 때까지 구속력이 없습니다. 계약은 회사가 서면으로 확인하거나 서비스를 개시할 때 성립됩니다.

4. 고객의 책임
고객은 서비스 수행에 필요한 모든 정보, 자료, 승인 등을 제공할 책임이 있습니다. 고객의 지연은 납기 연장으로 이어질 수 있습니다.

5. 책임 제한
회사는 간접적, 우발적 또는 결과적 손해에 대해 책임을 지지 않습니다. 책임은 고의 또는 중대한 과실에 한하며, 계약된 서비스 금액을 한도로 합니다.

6. 지적 재산권
기획안, 초안, 영상, 사진 및 기타 콘텐츠에 대한 모든 권리는 전액 결제가 완료될 때까지 회사에 귀속됩니다. 결제 완료 후 합의된 범위 내에서 사용 권한이 고객에게 이전됩니다.

7. 비밀 유지
양 당사자는 협력 과정에서 취득한 기밀 정보를 철저히 비밀로 유지합니다.

8. 관할 법원
Chacham SRL에 대해서는 루마니아 법이 적용되며 루마니아 법원이 관할합니다. Lovely Giants에 대해서는 대한민국 법이 적용되며 대한민국 법원이 관할합니다.

계약 조건

결제는 두 차례로 진행되며 각각 50%씩 청구됩니다.
첫 번째 결제는 촬영 후 청구되며, 두 번째 결제는 모든 인도물이 제공된 후 청구됩니다.

편집 및 수정
2회의 무료 수정이 제공되며, 추가 수정은 별도의 비용으로 진행됩니다.
편집본 제공 후 30일 이내에 피드백이 없을 경우, 프로젝트는 완료된 것으로 간주합니다.

자료 보유 및 삭제
프로젝트 완료 후 3개월 동안 클라이언트 자료를 보관하며, 별도의 서면 합의가 없는 경우 이후 자료는 영구적으로 삭제됩니다.

저작권
독점 저작권을 별도로 구매하지 않는 한, 제작사는 본 프로젝트 자료를 포트폴리오 및 홍보 목적으로 사용할 권리를 보유합니다.

계약 해지
클라이언트가 계약을 해지할 경우 다음과 같은 수수료가 발생합니다:
– 작업 시작 4주 전: 약정 금액의 10%
– 3주 전: 20%
– 2주 전: 30%
– 24시간 전까지: 60%
– 24시간 이내: 전액(100%) 청구

불가항력
천재지변, 사고, 질병 등 불가항력 상황이 발생할 경우, 프로젝트 일정과 조건은 상호 합의를 통해 조정될 수 있습니다.
이로 인한 지연, 취소 또는 변경에 대해서 제작사는 별도의 보상 의무를 지지 않습니다.

분쟁 해결
모든 분쟁은 우선 당사자 간 비공식 협상을 통해 해결을 시도합니다.
협상으로 해결이 불가능한 경우, 분쟁은 촬영이 발생한 지역의 관할 법원 또는 대한민국 내 관할 법원에서 중재를 통해 해결할 수 있습니다.
